Fort Lee Appeals Attorney

Aggressive Representation in Appellate Matters across New Jersey

If you believe your case was mishandled, leading to an unjust outcome, you may be able to appeal the ruling by submitting it to an appellate court. Appellate courts were established in order to address improper and wrongful representation and rulings, allowing individuals a method of having their cases overturned.

The Fort Lee appeals attorney at Charles Shaw Law has extensive experience representing clients in all types of appellate matters. Attorney Charles Shaw understands the appellate process and how to effectively advocate for you and your best interests.

To discuss whether or not you have grounds to file an appeal, contact our firm at (201) 289-5111 by submitting an online case evaluation form.

The Appeals Process in New Jersey

First and foremost, it is important to understand that you cannot appeal a judgment simply because you are unhappy with the outcome. You may only file an appeal if you believe your case was mishandled and/or an error or errors were made, leading to a wrongful judgment.

The process of appealing a ruling in New Jersey differs somewhat depending on the type of case and the court system it initially went through. For example, appealing a criminal conviction will be a different process than appealing a commercial litigation judgment. In either case, however, it’s important that you have an experienced appellate attorney on your side, as the process is complex and there are numerous steps you must take.

Generally speaking, when appealing a judgement, you will need to:

  • Provide your attorney with all documents related to your case, including the original judgement
  • File an official Notice of Appeal with the appropriate appellate court (various time limits apply)
  • Present an argument as to how your case was mishandled and how this led to an unjust ruling

The purpose of filing an appeal is not to hear new evidence or provide a new trial; rather, it is to review the actions of the lower court to determine is errors were made. If so, the appellate court has the power to modify or reverse the original ruling.
